Meeting Specifics: The Cedar Key City Commission met on Wednesday, December 4, 2019, at 5 pm, at Cedar Key City Hal. Present were Heath Davis, Sue Colson, Royce Nelson, and Susan Rosenthal. Jim Wortham was not in attendance.
Staff in attendance included: City of Cedar Key Attorney Norm Fugate, Police Chief Virgil Sandlin, Fire Chief and Emergency Operations Director Robert Robinson, City Clerk Crystal Sharp, Staffers Telicia Winfield and Jennifer Sylvester, and Legal Assistant to Mr. Fugate Leslie Landress.
Among those in the audience were: Rick and Vickie Crumpley, Janice Fugate, Jeri and Bob Treat, and Mandy and Frank Offerle.

Mayor Davis brought the meeting to order at 5:00 pm.
Present: Mayor Heath Davis, Vice-Mayor Sue Colson, Commissioner Susan Rosenthal, Commissioner James Wortham, Commissioner Royce Nelson, City Attorney Norm Fugate, Interim City Clerk Crystal Sharp.
Mayor Davis opted to forgo the Prayer and pledge.
There were no public comments.
Mayor Davis opted to change the order of discussion by moving item number 9, Consideration of Mediated Settlement Agreement, to first order. Mayor Davis explained current situation with lawsuit. Vice Mayor Sue Colson was chosen to give deposition at mediation, on behalf of the City. Mayor Davis questioned what the Commission's amount of authority was? City Attorney, Norm Fugate explained that the insurance company has unilateral decision to settle the case. All of the Commissioners were in agreement that this case is wrong and could mark the City Marina. All were in agreement to allow the Insurance Company to handle the case and settlement and that the Commission should not voice their decisions.
Rick and Vicki Crumpley were in attendance in part as the general public to gather further information regarding the case. Commissioner Wortham stated that at no time should there be any admission of fault by the City of Cedar Key.
Further discussion regarding the Library gutters and how to stop the leaks was brought up by Vice Mayor Sue Colson. Mayor Davis noted that the style of gutters met the historic design criteria and would recommend repairing existing and setting up a continued maintenance plan. City Clerk Crystal Sharp confirmed that there is currently a misc. repair fund in the amount of $1200.00. It was agreed that the gutter work would be taken care of under the misc. repairs fund.
Mayor Davis instructed the Public Works/Maintenance Dept. to fix the damaged road at 2nd Street vs. having contracted out. Instructions given to fill the hole with lime-rock and repair asphalt. Commissioner Nelson suggested filing a judgement against the at fault party for the damage. Police Chief Sandlin stated that driver did not have insurance.
Regarding the road repairs at the intersection of 3rd Str. and F Str., a site meeting to determine extent of damage to road and discuss schedule for repair was held. Mayor Davis asked that the storm drain at this intersection be examined further to find out if any area of the drain has been compromised. AT&T to advise date repair work is to start. Vice Mayor Colson stated that it has been well over a month and wanted it noted that we have waited long enough for repair to be taken care of.
Interlocal Agreement between Levy County Sheriffs Office and City of Cedar Key - Motion made by Commissioner Rosenthal to accept agreement. Vice Mayor Colson second. ROLL CALL VOTE: COMMISSIONER NELSON- YES, MAYOR DAVIS- YES, COMMISSIONER ROSENTHAL- YES, COMMISSIONER WORTHAM- YES, VICE-MAYOR COLSONYES. MOTION PASSES UNANIMOUSLY 5-0.
