Commission Votes Not to Appeal Buck Case

Following a closed meeting of the Cedar Key Commission December 19, Mayor/Commissioner Paul Oliver told Cedar Key News that the City will not appeal the court decision in favor of Ross and Dawn Buck. On a motion by Commissioner Pat O'Neal, seconded by Commissioner Vanessa Edmunds, the Commission voted 4 to 0 not to appeal the Buck decision. Commissioner Heath Davis did not vote, having left the meeting before adjournment.

The Buck law suit was a dispute over whether the Buck property was in a conservation zone or was zoned residential. A judge ruled in favor of the Bucks before the suit went to trial.

Mayor Oliver said that it is uncertain regarding a need for a small scale ammendment to the City`s Comprehensive Plan, but that City Attorney David Coffey must advise the Commission on what to do next.
