Individuals relying on Medicaid and Medically Needy coverage in Florida recently won a class action lawsuit in the courtroom of U.S. District Court Judge Alan Gold. The case challenged the state's failure to provide a written notice to Medicaid patients whose prescription coverage was denied regarding the reason for rejection and the right to appeal.


All who have experienced coverage rejections will now receive written notice explaining the reason for rejection, how to resolve the rejection and how to request an appeal if the rejection remains unresolved. The case also established specific circumstances in which recipients will continue to receive coverage for prescriptions during the appeal process. Additionally, the state will create an ombudsman office to resolve rejection claims.


As Chair of the Florida Transplant Survivors Coalition and a patient who relies on prescriptions to live, I want every Floridian to be aware of their new rights.
