Bucks Win Land Use Suit vs Cedar Key

A judge in U.S. District Court approved on December 4 a claim that the City of Cedar Key's interpretation of land use regulations improperly limited use of a waterfront property on Anna Street. Mayor/Commissioner Paul Oliver announced the court's decision at the December 5 Commission meeting, and said that the City's response to the decision will be presented at the January 9, 2007 Commission meeting.

The law suit, brought by Ross and Dawn Buck, resulted from the City Commission's reliance on a map that showed the Buck's property to be in a Conservation Zone. The Commission denied a Buck request to build a house on the property. The disagreement has gone on since 2004. Should the City decide to appeal the decision the case may go on for many more months. The City may become liable for the costs of the Buck suit.
